NEW ACCOUNT

No new account shall be accepted until a new account application form is submitted to Bonastar Pty Ltd. In order to request credit application from Bonastar Pty Ltd, the purchaser shall certify all the information provided is correct to the best of their knowledge.

GOODS & SERVICES

Prices quoted are based on current material prices. We reserve the right to re-negotiate these should the cost of material rise or fall by +/- 5% at the time of order. Quotations are subject to our standard terms and conditions, a copy of which will be supplied on request.

GUARANTEE & WARRANTY

(a) Subject to the provisions of the Trade Practices Act 1974 and any conditions, warranties and rights implied therein, any other warranties, representations and conditions are expressly excluded regarding goods supplied by Bonastar Pty Ltd. Bonastar Pty Ltd shall not be liable for any loss or damage whether direct, indirect or consequential occasioned to the Purchaser for whatever reason.

(b) Bonastar Pty Ltd's liability shall be limited to the replacement of goods supplied, which are found to be defective at the time they are supplied.

(c) The quantum of any claims made by the customer for product defects or detective workmanship as a result of the goods supplied by Bonastar or any other losses or damages incurred by the customer as a result of any act or omission of Bonastar shall be limited to the lesser of the price charged for the goods or the actual amount of the loss or damage incurred

PAYMENT AND PRICE

Unless otherwise agreed in writing, payment terms are STRICTLY nett 30 days from the date of statement with approved accounts. The price payable shall be that ruling at the time of delivery unless expressly agreed otherwise in writing. If payment is by cheque, payment shall be deemed to have been made when, and only when, the cheque is cleared by the bank on which it is drawn.

All Pricing as shown in our published Price List is subject to change without notice although every attempt will be made to give prior notice of any changes.

Where a Purchaser fails to adhere to payment terms, Bonastar Pty Ltd reserves the right to withhold further deliveries or cancel the contract without limiting its right to collect outstanding payments or cost involved in the custom-made product. Bonastar Pty Ltd from time to time may place limits on the amount of credit to be extended to the Purchaser.

COSTS ASSOCIATED WITH RECOVERY ACTION

The purchaser or customer shall pay Bonastar Pty Ltd on demand all cost and expenses including legal costs incurred by Bonastar Pty Ltd in the collection of any overdue account and the recovery of the goods pursuant to the powers herein contained.

TITLE

Title in the goods remain with Bonastar Pty Ltd until receipt of payment in full from the Purchaser. All goods shall be at the Purchaser's risk upon delivery to the Purchaser, his carrier or agent.

CANCELLATION BY PURCHASER

When an order requiring customization for a Purchaser is cancelled by the Purchaser, the Purchaser shall be liable for any costs incurred by Bonastar Pty Ltd in raw materials, tooling, packaging, ordering or any other matter, unless written agreement to vary this condition is supplied by Bonastar Pty Ltd.

WAIVER

Neglect or failure by the Company to insist upon strict performance of any of these conditions shall not be deemed a waiver of these conditions.
